Trade dress relates to the overall appearance of a product, packaging, theme and so on that is distinctive and unique. The theme can include a façade, a business presentation, a package design, a three dimensional shape, a graphic design, color, business presentation, slogans, smell or any combination of individual words, logos, designs and the like that contribute to the appearance of a commercial product or service. Trade dress generally does not relate to or include a functional feature.

Generally, protection of trade dress is obtained under trademark law.
